            Selectmen's Meeting - September 13, 1994

Selectmen Attending: Judith Murdoch, Charles Flynn, Joseph
Frisoli, Chair; Peter Jones; and Catherine Kuchinski, Clerk.
Also: Joseph Nugent, Board of Selectmen's Executive Secretary.  

I. Announcements: Chair Frisoli called meeting to order at 7:32pm
with the following announcements: (1) Bay State Electric holding
annual meeting; (2) Friends of Abby Smith "Olde Country Fair" on
Sunday, 9/18 at Camp Kiwanee; (3) East Bridgewater Board of
Selectmen letter announcing regional meeting set of 6:30pm 10/13.
Nugent to post meeting and will request an agenda beforehand for
Board's discussion.  To attend: Hanson, Halifax, Whitman,
E.Bridgewater, W.Bridgewater, and Bridgewater.  (4) U.N. Day is
October 24: Dukakis is chair of Greater Boston Chapter requesting
Towns to celebrate day with a proclamation and school activities.
Board to read Proclamation at an October meeting and forward
letter to schools encouraging a UN activity. (5) On behalf of
DARE officer Daley, Kuchinski announced the need for parents of
schoolaged children to become involved in DARE activities.

II. Memorandum of Agreement with Mass. Highways for State
Funding: Monies available to Hanson, under Chapter 85 Acts of
1994 and other Chapter 90 funds for other roads as well, amount
to $214,000 in FY95.  Harris to forward a list of roads on the
State Aid primary System. Motion 9/13/94.1: move to sign
Memorandum of Agreement with the Highway Dept. for State Highway
work in Hanson.  Motion made by Murdoch with second by Kuchinski.
Motion carried 5-0.

III. Minutes of Meetings: Motion 9/13/94.2: move to accept the
minutes of the August 2, 1994 Executive Session as corrected.
Motion by Jones with second by Kuchinski.  Motion carried 5-0.

Motion 9/13/94.3: move to accept the minutes of the August 30,
1994 meeting as previously corrected.  Motion by Flynn with
second by Kuchinski.  Motion carried 5-0.  No one knew who gave
Kuchinski the request to correct the minutes.

IV. Request for Common Victualers' license: Friends of Abby Smith
requesting approval. Motion 9/13/94.4: move to grant a one day
common victualers' license for Smith - Friends of Abby Olde Time
Country Fair for Sunday September 18 from 10am to 6pm.  Motion by
Kuchinski with second by Murdoch.  Motion carried 5-0.

V. Water Department - Shooting at Industrial Park Pit: Water Dept
requesting time with area neighbors Tassanari and McCollough
complaining that shooting occurs in the pit 7am - 11pm any day
with little response from the police department.  Police Chief
referred to a prior agreement (1976) with Water Dept that police
do shoot there to qualify 3-4 times per year.  Water Dept looking
for area to be posted No Shooting and for the area to be fenced.
Selectmen notified that fence bid procedure has been started and
will know more by Town Meeting after a meeting with the CIC and
receipt of bids.  More monies are needed to do the perimeter
fence as requested by Highway Surveyor and approved by May's Town
Meeting. Bickford acknowledged recent increased response by
Police department to neighbor's complaints. Neighbors would like
notification of police use.  Berry noted sign, fence and citizen
participation for enforcement goes a long way to resolving issue.
Motion 9/13/94.5: move to post the pit area at the Industrial
Park as a "NO SHOOTING" area.  Motion by Flynn with second by
Murdoch.  Motion carried 5-0.  Further comments made on bullets
used - no lead; the possible use of the Hanson Rod & Gun Club for
range access for qualifying practice (need B.O.D. approval).

VI. Police Union Contract: Board of Selectmen with members of the
Union (Larkin, Savage, Andrews) announced agreement on the
contract and a letter of understanding calling for $56,500 to be
requested at the October Town Meeting to settle contract
negotiations. Contract period is retroactive to July 1, 1993
through June 30, 1995. Motion 9/13/94.6: move to accept and sign
the Agreement and Letter of Understanding for contract to end
June 30, 1995.   Motion by Murdoch with second by Frisoli.
Motion carried 5-0.  Four copies signed for distribution.

VII. Discussion of Town Meeting Warrant Articles: The Board has
choice of Recommend, Do Not Recommend, Hold to September 27 for
further information, or Pass Over.  Motion to be made by Murdoch
with second by Flynn.  Kuchinski to move to HOLD with Jones to
second.  Board is voting on the article in principle.  Selectmen
articles to be assigned to particular member to present.

Motion 9/13/94.8: move to recommend Article Two.  Motion by
Murdoch with second by Flynn.  Motion carried 5-0.

relayed receipt of Town Counsel opinion giving clarification that
car is not a capital item; and internal transfer is allowed.
Motion 9/13/94.20: move to Hold Article Fourteen.  Motion by
Kuchinski with second by Jones.  Motion carried 5-0.
Motion 9/13/94.21: move to recommend Article Fifteen.  Motion by
Murdoch with second by Flynn.  Motion carried 5-0. (Kuchinski)
Motion 9/13/94.22: move to recommend Article Sixteen.  Motion by
Murdoch with second by Flynn.  Motion carried 5-0. (Flynn)
Kuchinski made comment she did not know of this article being
submitted.  Frisoli agreed process needs further information.
Motion 9/13/94.23: move to Pass Over Article Seventeen.  Motion
by Murdoch with second by Flynn.  Motion carried 5-0. (Kuchinski)
Motion 9/13/94.24: move to recommend Article Eighteen.  Motion by
Murdoch with second by Flynn.  Motion carried 5-0. Voc-Ed
reduction gives $19,000 assessment back and $21,000 needed top
fund articles 19 and 20.
Motion 9/13/94.25: move to recommend Article Nineteen - $11,000
for Highway Roof.  Motion by Murdoch with second by Flynn. Motion
carried 5-0.
Motion 9/13/94.26: move to recommend Article Twenty - $10,000 to
match monies from Gas Company to insulate Camp Kiwanee.  Motion
by Murdoch with second by Flynn.  Motion carried 5-0.
Motion 9/13/94.27: move to recommend Article Twenty-One.  Motion
by Murdoch with second by Flynn.  Motion carried 4-0-1 (Jones).
Motion 9/13/94.28: move to recommend Article Twenty-Two.  Motion

Motion 9/13/94.35: move to Hold Article Twenty-Nine.  Motion by
Kuchinski with second by Jones.  Motion carried 5-0.  McCormack's
memo questioned parcel ownership by Town entity. Clarks and their
attorney (McCluskey) appeared noting discontent with not knowing
full extent of area requested in warrant article.  Water dept has
not been allowed on property for several weeks - need a day or
two to complete survey, testing for DEP approval.  Attorneys to
talk shortly for resolution of access issue.

Motion 9/13/94.44: move to Hold Article Thirty-Eight.  Motion by
Kuchinski with second by Jones.  Motion carried 5-0.

For Article 13 preparation, Frisoli requested CIC member be
involved as a courtesy in discussion with Water Department and
Selectmen to agree with figure for possible transfer.
Professional appraisal to be sought by water department.

VIII. Pleasant Street - Brookside Development (South Shore
Housing): Mrs. Merry looking for assistance to find out current
status of the project under a comprehensive permit.  Nugent
instructed to request information from all Boards and South Shore
Housing.  Mrs. Merry informed the Board that she had turned in
information to the Selectmen's office in April of 1993 and April
of 1994 but had yet to have reply.  Nugent to be in touch with
her by the end of the week.  

IX. Action Requests: (1) Kuchinski requested a letter of
congratulations be sent to Lauren Belden for her cheerleading
success- participation in Westminster, England parade on New
Year's Day 1995.  Motion 9/13/94.45: move to send letter of
congratulations to Ms. Belden.  Motion by Kuchinski with second
by Jones.  Motion carried 5-0.    (2) Kuchinski requested status
of Building Inspector's Committee on small lot development;  (3)
Kuchinski requested monthly report from Building Inspector on all
complaints and general activities;  (4) Kuchinski requested
meeting with Citizen ADA Committee for update on activities;  (5)
Kuchinski encourage Town employee attendance 9-30-94 at Stonehill
College for Bridge Repair - Non-point source discharge seminar in
light of upcoming public hearing on State Street Bridge Repair
over the Indian Head Brook;  (6) Kuchinski requested completion
of the IRS situation by asking for two agents to attend a
Selectmen's meeting. Motion 9/13/94.46: move to request IRS
situation attend evening Selectmen meeting. Motion by Kuchinski
with second by Jones for discussion.  Motion failed 1-4 (Murdoch,
Flynn, Frisoli, Jones).  Flynn reported his call to auditors who
assure him that firm has been in contact with employees and
although problem occurred in past, they are certain that proper
procedures are in place now.  Auditors satisfied.  No one opposed
to Kuchinski arranging or posting a meeting for time other that
Selectmen agenda.  (7) Kuchinski requested Executive Secretary
report be tried at the beginning of the meeting - gives Nugent
opportunity to give update on on-going issues - Route 58,
landfill, etc.  Consensus agreed to this request.  (8) Frisoli
displeased with Coffey's position reported in newspapers on his
desire to dissolve the Region.  Frisoli wanted Board not to allow
meeting with schools to be a unified position of the Towns
against the Schools if there is a suggested hidden agenda.  Other
members urged him to ignore Coffey's position and continue to do
positive work to establish definition and procedures for capital
items.

X. Hanson Manor: Nugent read reports from Building Inspector and
Health Agent who are continuing to monitor progress on code
violations.  Final inspection set for September 26 with license
application expected for the September 27 Board meeting.
Kuchinski encouraged owners' attendance one way or the other to
bring closure to this matter. Nugent noted 85% of violations have
been corrected.  Frisoli noted displeasure he had to seek out
this report - Board should be regularly informed of activities.

XI. Executive Secretary Report: (1) Assessors - Small Commercial
Exemption: would require split tax rate - Classification hearing
expected shortly.   (2) Police Chief presentation on Lieutenant's
position: Board must consider taking a stand after next
presentation so that case preparation on a related labor issue
can continue.  (3) Preparation of motions with information on
articles to be prepared and available shortly.

Tom Dahlberg requested a moment to voice his request that if a
citizen's name appears on Town Hall memo that a copy of it be
forwarded to that individual.  Discussion occurred over the
8/30/94 meeting in which the Small Vehicle plan was discussed by
Dahlberg who had copies of purchase orders for Town vehicles.
Subsequently, Town Accountant sent a memo to the Board indicating
that Dahlberg had the wrong information and requesting him to
speak to her for information in the future.

XVI. Adjournment. Motion 9/13/94.47:  move to adjourn.  Motion
made by Jones with second by Kuchinski. Motion carried 5-0. Board
adjourned at 11:13pm.
